These Terms & Conditions (“Terms”) govern (a) your use of the Coaching Beyond website at www.coachingbeyond.in (the “Website”), and (b) your participation in Coaching Beyond cricket coaching programmes, training sessions, camps, clinics, events and related services (the “Programmes”).
By accessing the Website, submitting an enquiry, registering for a Programme, making a payment, or participating in any Coaching Beyond Programme, you agree to these Terms.
Where a player is under 18 years of age, these Terms apply to the player and their parent or legal guardian, and the parent/legal guardian is responsible for providing the required consent and information.
1. About Coaching Beyond
Coaching Beyond provides cricket coaching, training and athlete development programmes designed for players of different ages and skill levels. Our Programmes may include, depending on the programme and location:
- Group coaching
- Focused coaching
- Skill clinics
- Strength and conditioning
- Athlete development programmes
- High-performance training
- Training camps
- Workshops and other cricket-related programmes
Programme availability, schedules, locations, coaches, session structures and fees may vary.
2. Scope of the Website
The Website is provided for informational purposes and to allow visitors to make enquiries about our Programmes. Currently, the Website:
- Displays information about Coaching Beyond and our Programmes;
- Allows visitors to submit enquiries; and
- Provides a login facility through which a registered user can view their own previously submitted details.
The Website does not currently process Programme registrations, bookings, or payments. Registration, enrolment and fee collection for Programmes are carried out through offline or other channels communicated separately by Coaching Beyond, and not through the Website. If this changes in future, this section will be updated accordingly.
3. Player Registration and Eligibility
Players must be registered through the applicable Coaching Beyond registration process, which is currently conducted offline / through channels other than the Website, before participating in a Programme.
Parents or legal guardians registering a minor must provide accurate and complete information about the player. Coaching Beyond may request information including:
- Player name and age
- Date of birth
- Parent/guardian details
- Emergency contact information
- Cricket experience and playing level
- Relevant medical or fitness information
- Other information reasonably required for programme participation
Coaching Beyond reserves the right to determine the appropriate programme, group or training level for a player based on the information available and the requirements of the programme.
4. Parent/Guardian Consent for Minors
For players under 18, registration and participation may require consent from a parent or legal guardian. The parent or legal guardian confirms that:
- They are authorised to provide consent for the player.
- The information provided during registration is accurate.
- They have informed Coaching Beyond of relevant medical, health or safety information.
- They understand the nature of the cricket training and activities.
- They agree to the applicable programme rules and policies on behalf of the minor.
Coaching Beyond may refuse or suspend participation where required consent or information has not been provided.
5. Health, Fitness and Medical Information
Players are expected to be physically capable of participating in the relevant training activities. Parents/guardians or adult players must inform Coaching Beyond about any relevant:
- Medical conditions
- Injuries
- Allergies
- Physical limitations
- Fitness restrictions
- Other circumstances that may affect safe participation
Coaching Beyond may recommend that a player obtain appropriate medical advice before participating where a health or safety concern arises. Coaching Beyond is not a substitute for professional medical advice or treatment.
6. Programme Fees and Payments
Programme fees will be communicated during the registration or booking process. Fees may vary depending on:
- Programme
- Location
- Duration
- Training format
- Number of sessions
- Camps or special events
- Other programme-specific factors
No payments are collected or processed through the Website. All fees are collected offline or through other channels communicated by Coaching Beyond at the time of registration.
Registration is considered confirmed only after the applicable registration requirements and payment conditions have been completed. Parents/guardians and players are responsible for ensuring that payments are made within the applicable timelines.
7. Cancellation, Withdrawal and Refunds
Cancellation, withdrawal and refund requests will be handled in accordance with the applicable Coaching Beyond refund/cancellation policy communicated for the relevant programme. Different programmes may have different cancellation or refund conditions. Where a programme-specific refund policy applies, that policy will take precedence over general provisions relating to refunds.
Coaching Beyond may deduct applicable administrative, processing or other permitted charges before issuing a refund.
8. Missed Sessions and Make-Up Sessions
Players are expected to attend their scheduled sessions. Unless otherwise communicated for a particular programme:
- Missed sessions by a player do not automatically qualify for a refund.
- Make-up sessions are not guaranteed.
- Make-up sessions may be offered at Coaching Beyond's discretion, subject to availability.
- Make-up sessions may be subject to programme-specific conditions.
Sessions missed due to personal travel, school commitments, illness or other personal circumstances may not be eligible for replacement.
Any specific make-up arrangements communicated for a particular programme will apply to that programme.
9. Academy Cancellation, Postponement and Schedule Changes
Coaching Beyond may cancel, postpone, reschedule or modify a session or programme due to circumstances including:
- Severe weather
- Unsafe playing or training conditions
- Facility or ground availability
- Coach availability
- Operational requirements
- Public events
- Government restrictions
- Force majeure or circumstances beyond reasonable control
Where reasonably possible, Coaching Beyond will communicate significant changes to players or parents/guardians. Where a session is cancelled by Coaching Beyond, an alternative session, rescheduling arrangement or other appropriate resolution may be provided in accordance with the applicable programme policy.
10. Attendance and Punctuality
Players are expected to arrive at the designated venue on time and be prepared for the scheduled session. Late arrival may reduce the player's available training time and does not automatically entitle the player to an extended or replacement session.
Parents/guardians are responsible for ensuring that minors arrive at and leave the designated location in accordance with the academy's communicated arrangements.
11. Player Conduct
Players are expected to behave respectfully and responsibly towards coaches, academy staff, other players, parents/guardians, venue staff, officials, and equipment and facilities.
Coaching Beyond does not tolerate:
- Bullying
- Harassment
- Threatening behaviour
- Physical or verbal abuse
- Discrimination
- Intentional damage to property
- Unsafe or seriously disruptive behaviour
Coaching Beyond may suspend or terminate a player's participation where conduct presents a safety, disciplinary or operational concern.
12. Safety and Academy Rules
Players must follow reasonable instructions given by coaches and academy staff relating to training activities, use of equipment, ground/facility rules, warm-up and cool-down, protective equipment, player safety, and emergency procedures.
Failure to follow safety instructions may result in removal from a session or suspension from a programme.
13. Cricket Equipment and Personal Belongings
Players are responsible for bringing the equipment required for their programme unless otherwise communicated. Players and parents/guardians are responsible for personal belongings brought to training locations.
Coaching Beyond will not be responsible for loss, theft or damage to personal belongings except where liability cannot legally be excluded.
14. Photography and Video
Coaching Beyond may photograph or record training sessions, matches, camps, events and other academy activities. Where required, appropriate consent will be obtained before using identifiable images or videos for promotional or communication purposes.
Parents/guardians may contact Coaching Beyond regarding photography or video consent using the official contact details in Section 29.
15. Website Content and Availability
We make reasonable efforts to ensure that information published on the Website is accurate and up to date. However, programme details, schedules, coaches, locations, fees and availability may change. Website content is provided for general informational purposes and should not be treated as a guarantee that a particular programme, coach, facility, schedule or service will always be available.
We do not guarantee that the Website will be available at all times or free from interruptions, errors or delays, and we are not liable for any loss arising from Website downtime or unavailability, except where liability cannot legally be excluded.
16. Account and Login
Where the Website provides a login facility, this is currently used only to allow a registered user to view their own previously submitted details. You are responsible for:
- Keeping your login credentials confidential;
- All activity that occurs through your account; and
- Notifying us promptly if you believe your account has been accessed without authorisation.
Coaching Beyond may suspend or restrict access to an account where we reasonably believe it is necessary for security, safety, or operational reasons. Personal information shown through the login facility is handled in accordance with our Privacy Policy (see Section 20).
17. Intellectual Property
Unless otherwise stated, the content on the Website, including text, logos, branding, graphics, images, videos, designs, training materials and other website content, is owned by or licensed to Coaching Beyond and is protected by applicable intellectual property laws.
You may not reproduce, modify, distribute, publish, sell or commercially exploit Coaching Beyond content without prior written permission.
18. User-Submitted Content
If you voluntarily submit photographs, videos, testimonials, reviews or other content to Coaching Beyond, you confirm that you have the necessary rights and permissions to provide that content. Where required, Coaching Beyond will obtain appropriate consent before using submitted content for promotional or other purposes.
19. Third-Party Links
The Website may contain links to third-party websites or services. These links are provided for convenience or informational purposes. Coaching Beyond does not control and is not responsible for the content, availability, security or privacy practices of third-party websites.
20. Privacy and Cookies
Personal information collected through the Website, the registration process, and participation in Coaching Beyond programmes, including information collected automatically through cookies and similar technologies, is handled in accordance with our Privacy Policy, which is designed to reflect the principles of the UK General Data Protection Regulation (UK GDPR) and India's Digital Personal Data Protection Act, 2023 (DPDP Act), including lawfulness, fairness and transparency, purpose limitation, data minimisation, accuracy, storage limitation, and appropriate security. Our Privacy Policy explains how we collect, use, store and protect personal information, including information relating to players and minors, and sets out full details of the cookies we use (including Google Analytics 4), their purpose, and how to manage or withdraw your consent.
21. Limitation of Liability
Cricket and physical training activities involve inherent risks, including the possibility of injury. Coaching Beyond takes reasonable measures to promote safe training practices and expects players to follow coach and facility safety instructions.
To the extent permitted by applicable law, Coaching Beyond will not be responsible for losses, injuries or damages arising from:
- Failure to follow safety instructions
- Failure to disclose relevant medical or health information
- A player's own negligent or unsafe conduct
- Circumstances outside Coaching Beyond's reasonable control
Nothing in these Terms is intended to exclude or limit any liability that cannot legally be excluded or limited under applicable law.
22. Indemnification
You agree to indemnify and hold Coaching Beyond, its coaches, staff and representatives harmless from any claims, losses, liabilities or expenses (including reasonable legal fees) arising out of your misuse of the Website, your breach of these Terms, or your violation of any applicable law, except to the extent such claims arise from Coaching Beyond's own negligence or wilful misconduct.
23. Changes to Programmes and Services
Coaching Beyond may modify its programmes, schedules, locations, coaching staff, facilities or services from time to time. Where reasonably possible, material changes affecting registered participants will be communicated in advance.
24. Force Majeure
Coaching Beyond will not be responsible for failure or delay in providing services where the failure or delay results from circumstances beyond our reasonable control, including but not limited to:
- Natural disasters
- Severe weather
- Government restrictions
- Public emergencies
- Epidemics or pandemics
- Facility closures
- Strikes or labour disruptions
- Infrastructure failures
- Security incidents
- Other unforeseen circumstances
Where reasonably possible, Coaching Beyond will attempt to provide an alternative arrangement.
25. Suspension or Termination of Participation
Coaching Beyond may suspend or terminate a player's participation where:
- Required registration information is inaccurate or incomplete
- Required consent has not been provided
- Fees remain unpaid
- Academy rules are repeatedly breached
- Behaviour presents a safety risk
- The player engages in serious misconduct
- Participation is otherwise inconsistent with the requirements of the programme
Any refund following suspension or termination will be handled in accordance with the applicable programme and refund policy.
26. Changes to These Terms
Coaching Beyond may update these Terms from time to time to reflect changes to our programmes and services, our business practices, website functionality, operational requirements, or applicable laws or regulations. The updated version will be published on this page with a revised Last Updated date.
27. Severability
If any provision of these Terms is found to be invalid, illegal or unenforceable by a court or authority of competent jurisdiction, that provision will be severed, and the remaining provisions will continue in full force and effect.
28. Governing Law
These Terms shall be governed by and interpreted in accordance with the applicable laws of India. Any disputes arising in connection with these Terms or Coaching Beyond's services shall be subject to the jurisdiction of the appropriate courts in India, unless otherwise required by applicable law.
